DESCRIPTION | This event comprises a series of criminal moot court competitions between law students hailing from all years. Each registered team is given a fictitious case boasting a criminal aspect, and is assigned either the role of prosecution or defending counsel. The event is wholly presided by official members of the Judiciary of Malta, who provide a detailed report of each contestant’s performance after each legal contest in court. All litigating sessions are held at the Law Courts in Valletta, Malta. This criminal law aspect of this event pertains to topics discussed in the law course – tackling notions such as Homicide, Bodily Harm, Conspiracy, Rape, and more. The prize awarded to the winning team entails the opportunity of participating in ELSA UK’s ‘COMMOOT’ – which is a Commercial Law Moot Court based in Westminster, London, inviting litigation teams from all across Europe. The winner’s trip to the United Kingdom is sponsored by various law firms partnered up with ELSA Malta. All students from any university course and background are invited to watch and participate as jurors in all cases – thus determining the winning party of all respective cases held in this event by virtue of a vote. Finally, teams comprising of first-year law students are assigned a member of the ELSA Malta National Board to assist them in their litigating experience. Judges, Magistrates, Lawyers, and Politicians are invited as spectators for this event. Study-unit Aims: - Learning how to read, analyse, interpret, and tackle a criminal case. - An actual hands-on opportunity for litigating in court. - An active learning experience of the ins and outs of the Law Courts in Valletta, Malta. - Networking opportunity with Judges, Magistrates, Laywers, and other notable entities. Learning Outcomes: 1. Knowledge & Understanding: By the end of the study-unit the student will be able to: - Read and analyse the principal offences of Maltese Criminal Law. - Interpret Criminal Law provisions and use them to their respective advantage in court, depending on their side of the fray. - Litigate in a clear manner in front of Judges and Magistrates akin. - Litigate and convince the jury to vote for them in order to win the case. 2. Skills: By the end of the study-unit the student will be able to: - Apply, interpret, and effectively argue about criminal law provisions pertaining to the given facts and cases. Choose the best course of action in order to ascertain a win either from the prosecuting or defending side. |
