DESCRIPTION The study-unit dwells on intellectual property in the EU legal framework. For this reason, it is divided in two parts. In the first one will be explored how the European Union’s attempt at harmonisation of intellectual property (copyright, patents, trademarks and designs) legislation and its efforts to establish a Unitary patent, trademark and design are contrasted with the harmonisation exercise being conducted at the international level (WTO and WIPO).

The second part of the study-unit examines the relationship between EU law and intellectual property rights especially where free movement of goods and EU Competition rules are concerned. In this regard reference is made to the principles that have evolved through ECJ case-law on the subject while the relevant block exemption regulations are analysed.

Study-Unit Aims:

The study-unit aims at presenting a general overview of the legal issues related to intellectual property under an EU law perspective, including the Unitary patent. Through this study-unit, students will understand why intellectual property and its protection is fundamental to fostering innovation and creativity at EU level and why it represents one of the pillars of the Digital Single Market strategy of the European Commission.

Learning Outcomes:

1. Knowledge & Understanding:

Students are expected to gain an in-depth understanding of the rationale, principles and issues underlying the various EU harmonisation directives relating to IPRs and the EU regulations establishing unitary EU-wide IPRs and the impact that these measures have had on national laws and on the rights of IPR holders and users. All this is discussed in the light of international efforts at WIPO and WTO at harmonising intellectual property laws and centralising and simplifying registration and the effect that the European Patent Convention has had on national patent laws so that the student may obtain a holistic view.

2. Skills:

The object of the study-unit is to contextualise these legislative measures not in isolation but within the wider perspective of the Internal Market objective. The study-unit, in fact, also explores the interface between IPRs and competition law and the free movement provisions of the Treaty on the Functioning of the European Union.
