| DESCRIPTION | The EST1022 study-unit covers the main heads of the European Union's Legal Order. It begins with a chronological history of the development of the legal order, tracing the conclusion of the first Treaties and the various amending treaties up to the present time. From the outset, this study-unit highlights the contribution of the European Court of Justice to this development. Next, it provides an overview of the institutions of the Union, briefly discussing their composition and powers, including the concept of institutional balance. Following this, the study-unit highlights the categories of EU competencies, alongside the associated principles of conferral, subsidiarity, and proportionality. The next topic focuses on decision-making in the Union, emphasising the Community method, exploring the nature of the instruments that the Union adopts, and examining the hierarchy of norms. Subsequently, the Principle of Supremacy or Primacy of Union Law is discussed, analysing the relationship between Union Law and National Law. Then, the study-unit explores the core doctrines or principles of EU law, as developed by the Court of Justice: Direct Applicability, Direct Effect, Indirect Effect, and State Liability. The objective of this study-unit is to cover the main elements of the so-called EU Legal Order, which applies across the sphere of competences of the Union. Students will develop an understanding of the legal perspective on the evolution and workings of the Union, emphasising the relationship between Union Law and National Law, and the approach of the European Court of Justice in interpreting, developing, and applying Union Law.
