DESCRIPTION The study-unit covers the various principles governing EU Competition law as evolved by the European Commission and the Court of Justice of the EU in the interpretation and application of Articles 101 and 102 of the TFEU and related EU legislation. It also covers the procedures involved in the enforcement of Articles 101 and 102 of the TFEU.

Study-Unit Aims:

The study-unit aims to provide the student with an in-depth understanding of the substantive EU competition rules, namely Articles 101 and 102 TFEU. The underlying concepts and elements of these Articles, as well as relevant secondary legislation and interpretative notices and guidelines, will be explained and discussed in detail. The doctrine, jurisprudence and major developments concerning Articles 101 and 102 will also be delved into. The procedures involved in the application and enforcement of the competition rules, particularly the significant role played by the European Commission, will be examined.

Learning Outcomes:

1. Knowledge & Understanding:

By the end of the study-unit the student will be able to:

- Interpret and discuss Articles 101 and 102 TFEU and related case law;
- Interpret and discuss related EU secondary legislation and European Commission Guidelines;
- Interpret the procedures involved in the application of Articles 101 and 102 TFEU;
- Interpret the role of the European Commission and the national competition authorities in enforcing the competition rules;
- Interpret better the role of the Court of Justice of the EU.

2. Skills:

By the end of the study-unit the student will be able to:

- Analyse a case involving competition law issues and determine how the competition rules apply to a particular set of facts;
- Read and understand better the decisions of the European Commission;
- Read and understand better the judgements of the Court of Justice of the EU.
