DESCRIPTION | This study-unit studies the historical sources of Maltese Constitutional Law comprise documents in the State and other archives of England and Malta. Such documents vary from Constitutional texts to juristic writings. They also include judgments of the Constitutional Courts and other appellate courts. They also include textbooks by historians and other academics who wrote about the political and constitutional development of the country. Needless to say, the non-state archives encompass the Church holdings and records given that the Church played an important constitutional and political role in the historical development in Constitutional law in Malta. Another vital source of information are local, Italian and Maltese newspapers which are a direct source of public opinion. Study-Unit Aims: This study-unit traces the historical evolution of Constitutional Law in Malta. It studies the various constitutions during British colonial time and the independence constitution, the reports written thereupon, the discussions and adoption of the various Constitutions as well as subsequent changes made thereto both under the British period and post-independence. Learning Outcomes: 1. Knowledge & Understanding: By the end of the study-unit the student will be able to: - identify the main sources of the Maltese Constitutions; - discuss the various versions that lead to the drafting and subsequent approval of the various Constitutions adopted over time; - trace the influence that reports had in the eventual development of the Constitutions of Malta. 2. Skills: By the end of the study-unit the student will be able to: - write about the historical development of the Constitutions of Malta; - contextualise the development over time of the provisions of the Maltese Constitutions; - compare and contrast the various the provisions of the Maltese Constitutions as they evolved over time.
