DESCRIPTION | This study-unit will study the procedure before the Industrial Tribunal, the Environment and Planning Review Tribunal, the Administrative Review Tribunal and the Tourism Appeals Tribunal. It will compare and contrast the jurisdiction of these tribunals and explain salient cases decided by the Maltese Courts relating to the functioning of these quasi-judicial tribunals. Study-unit Aims: This study-unit aims to introduce the student to the operation of quasi-judicial tribunals in Malta and to leading case law of these tribunals. The tribunals are: the Industrial Law the Environment and Planning Review Tribunal, the Administrative Review tribunal and the Malta Tourism Appeals Tribunal and the laws which regulate their operation. Learning Outcomes: 1. Knowledge & Understanding: By the end of the study-unit the student will be able to: (a) know the applicable rules of procedure before the Industrial Tribunal, the Environment and Planning Review Tribunal and the Tourism Appeals Board; (b) understand which cases can be referred to the Industrial Tribunal, the Environment and Planning Review Tribunal and the Tourism Appeals Tribunal; (c) comprehend the procedure for review of decisions delivered by the Industrial Tribunal,. the Environment and Planning Review Tribunal and the Tourism Appeals Tribunal. 2. Skills: By the end of the study-unit the student will be able to: (a) identify the proper law regulating the Industrial Tribunal, the Environment and Planning Tribunal and the Tourism Appeals Board and the procedure followed by this Tribunal in its determination of disputes; (b) interpret the cases which may be referred to these Tribunals for determination; (c) comment and write on the procedure followed by when reviewing decisions of the Industrial Tribunal, the Environment and Planning Review Tribunal and the Tourism Appeals Board.
