DESCRIPTION | The study-unit will focus on three different aspects of migration and human rights law. Firstly, it will analyse laws related to migration, refugee status, humanitarian protection and humanitarian aid, and consider the protection of human rights of migrants in national as well as international law. Secondly it will consider human trafficking as an organised crime and will analyse laws related to the punishment of perpetrators, systems related to the prevention of human trafficking and the rights of the victims of human trafficking. Thirdly, it will focus on human smuggling and analyse its implications for human rights law. Study-Unit Aims: To analyse the protection, interpretation and application of human rights law to issues of migration, human trafficking and human smuggling. To consider national and international law on migration, human trafficking and human smuggling and analyse the methods of prevention, protection and punishment. Learning Outcomes: 1. Knowledge & Understanding By the end of the study-unit the student will be able to: - Analyse the protection, interpretation and application of international and national laws related to migration, human trafficking and human smuggling; - Identify and analyse relevant caselaw and consider the principles developed by courts and tribunals in this field. 2. Skills By the end of the study-unit the student will be able to: - Provide a written analysis of the different application of international and national laws related to migration, human trafficking and human smuggling; - Provide a written analysis of the effectiveness or lack thereof of the systems of prevention related to migration, human trafficking and human smuggling.
