Abstract: | The Environment Protection Act, 2016 re-enacts with substantial amendments and updates the Environment Protection Act, 2001. It came into force on the 8 January 2016 as 'an Act to make provision for the protection of the environment and for the establishment of an authority with powers to that effect'. Of relevance for the purposes of tort law are the provisions of art 70 which provides that: '70. The Minister (responsible for the environment) may, from time to time, by means of regulations introduce measures relative to the liability to be incurred by any individual who is, in any manner, deemed responsible for any action that may cause environmental damage, whether in relation to a protected area, or in general. Such regulations may also include measures relating to the prevention and remedying of such environmental damage.' [Excerpt] |
