Abstract: | Over the years, as the prison population in Malta has drastically increased, putting further strain on Malta's only prison institution, the prison administration must continue to ensure that the human rights of such prisoners are maintained and respected throughout the sentence of such prisoner irrespective of what crime that person has committed. This thesis sets aside the debate on the length of a prisoner's sentence and whether a person should in fact be sent to prison and instead focuses on the fundamental rights of prisoners that must be respected. Such rights are seen in relation to the fact that whilst a prisoner loses his liberty upon incamation, that prisoner's dignity remains intact and can never be taken from him! This thesis analyses the European legislation and European judgments and compares these to the situation that exists at Corradino Correctional Facility. Consideration is given to whether Malta's position is in line with European standards. Where shortcomings have been noted, recommendations are put forward. |
