Abstract: | This dissertation will focus on the Maltese Courts’ interpretation of Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters since Malta’s accession to the European Union in 2004. Separate chapters will be dedicated to civil and commercial matters, contract and tort, prorogation of jurisdiction as well as recognition and enforcement of judgments, thereby facilitating a critique of the judgments of the Maltese Courts by subject matter. The critique will attempt to delineate interpretational trends of the Maltese Courts and to distil differentiation, if any, with the case law of the European Court of Justice. |
