dc.description.abstract | The essay appertains to the Regulation issued by the European Union (EU) concerning the distribution of life insurance products. Therefore, in this paper we refer to the following regulatory framework when it comes to the EU regulation on insurance. The EU rules on insurance and reinsurance undertakings make up a discipline of maximum harmonization, which has been brought by Directive 2009/138/EC, which in its turn is more commonly known as Solvency II, and the implementing measures1. With reference to insurance intermediaries as well as business conduct rules on the distribution of insurance products, there is a minimum level harmonization. The adoption of Directive 2016/97/EC on insurance distribution (IDD)2, which repeals Directive 2002/92/EC on insurance mediation (IMD), has recently expanded this harmonization. All distributors of insurance products, i.e. insurers and intermediaries, fall within the scope of the IDD and Member States are to have transposed the IDD into national laws by February 2018.
