Abstract: This article describes the new approach to the customer protection in the financial services including insurance adopted by EU after the financial crisis of 2007. As a result of this approach, product oversight and governance has been introduced in the IDD and further detailed in the Guidelines that will be issued by EIOPA. This article provides an overview of this new set of rules. It looks for the rationale behind of rules analysing their contents and making some suggestions on the principle of proportionality which they refer.
