Abstract: | "In the context of a life sentence, article 3 of the European Convention on Human Rights must be interpreted as requiring reducibility of the sentence" On November 7, 2016 in a case instituted by Ben Hassine Ben Ali Wahid. a Tunisian national, the Constitutional Court delivered a landmark judgment by declaring that a non-reviewable life sentence in terms of Maltese criminal law was in breach of the applicant's fundamental rights under Article 3 of the European Convention on Human Rights. |
