| Abstract: | The paper contributes to the debate on the future of the governance of European financial regulation and supervision, triggered by the Commission’s review of the European System of Financial Supervision (ESFS) in 20131 and the current debate on the establishment of a Capital Markets Union (CMU).2 EU securities regulation is harmonized to a maximum degree (single rulebook), while supervision remains a national competence (with the exception of credit rating agencies and trade repositories which are supervised by European Securities and Markets Authority (ESMA)). The paper critically examines past and existing mechanisms for securities regulation and supervision within the context of the internal market. It analyses the importance of mutual trust and cooperation between financial supervisors for effective supervision and the mechanisms devised by policy makers for this purpose. This is one of the main contributions of the paper. |
