Abstract: The use of technology in sports has become increasingly prevalent, leading to a focus on the acquisition of the finest technology and sports equipment, in addition to the physiological capabilities. The aim of this dissertation is to examine the lacunae that currently exists in the anti-doping legislation at both an international and national levels, as well as to highlight the need for further development in this area. The study specifically focuses on the concept of techno-doping, a term that as yet is not fully understood within the sporting community. With technological advancements in sports equipment and performance-enhancing technologies, the potential for gaining an unfair competitive advantage has significantly increased. This study aims to shed light on the discrepancies that arise when determining whether or not an athlete should be disqualified for the use of such technologies. This is particularly relevant in light of the famous Pistorius case, which highlighted the challenges faced by adjudicating bodies in determining whether an athlete has gained an unfair advantage through the use of technology. By reviewing the current anti-doping legislation, as well as analysing relevant case studies the author aims to determine the extent of the difficulty which legislation on techno-doping is facing as well as identifying areas where anti-doping legislation needs to be improved. The findings of this study are expected to contribute to the development of anti-doping legislation that is effective in addressing the challenges posed by technological advancements in sports. It is hoped that this will lead to clarity for anti-doping legislation particularly in relation to techno-doping in order to provide guidance for both athletes and adjudicating bodies.
