Abstract: One of the thornier issues confronting European regulations that include mechanisms for constitutional control is that of "double reference for a preliminary ruling''. A recent case came to be of interest after it was subject to a reference ex art. 267 TFEU by the French Court of Cassation_and was concluded only after the intervention of the Court of Justice. Thus, with the objective to understand the , possible ramifications of the French constitutional,' reforms on the entire European system, this paper shall explore what appear to be the new elements of the French system regarding the primacy .' of European law.
