Abstract: Article 32(3) of the original Development and Planning Act (Chapter 356 of the Laws of Malta), required an applicant for a development permission to certify that he was either the owner of the site in question, or that he had otherwise ‘notified the owner of his intention to apply by registered letter of which a copy ha[d] been received by the Authority.’ The question as to whether an applicant was also required to obtain consent from the owner after giving notification was, at the time, open to interpretation.
