Abstract: Despite there being a handful of cases relating to malpractice in a notariat which consists of around 400 practicing notaries, such cases have made the headlines and front pages each and every time, as the notary is supposed to be one of the most trusted individuals in society. Therefore, discussion should be warranted in order to investigate whether or not current legislation and regulations are sufficient enough to combat such issue, and whether past jurisprudence has established judgements which are just and appropriate, and also whether there is room for improvements in order to mitigate malpractice as much as possible. By navigating through these issues, the professional report strives to contribute to the discourse surrounding notarial malpractice and the initiatives to mitigate such problem as best as possible by suggesting potential pathways which could improve the legal integrity of the notarial profession in Malta.
