Abstract: The notarial profession and mediation are said to coexist and this in virtue of the characteristics that a notary holds being in line with the characteristics that a mediator would hold. Whether this is regulated or not is a topic worth discussing. This research paper will seek to analyse mediation when it comes to notarial situations wherein the notary is to act as mediator. The law attesting to this will be analysed so as to conclude whether further legislation would be needed to clarify the situation at hand or not.
