dc.description.abstractLegal discussions of human rights do not usually address fundamental questions such as why they exist and, in a very few remote cases where they are absolute, why they are so. For example, it is often taken for granted that the prohibition of torture under national, regional and international human rights laws is absolute and admits of no exception. This article will assess the justification for the claim that freedom from torture is an absolute right.en_GB
