Abstract: Regularisation programmes and instruments that have been applied in Europe in an attempt to manage the problem of irregular immigration have generated highly disputed discussions, mainly because they serve to solve dysfunctions of the legal immigra,tion management policies. Regularisation programmes are applied to grant - in a retrospective way - legal status, meaning rights and duties, to people who are already in the country. The main objective of this paper is to analyse to what extent regularisation instruments in Europe are an unexpected path for managing (irregular) immigration and for promoting immigrants' rights.
