Abstract: The introduction of the "Living Will" in the Legislation is a very hard matter to deal with for the Italian Parliament. It involves a very complex interweaving of technical legal as well as legal-philosophical issues, because of the catholic roots of the Italian constitutional identity. The Author suggests a soft-law solution in order to avoid an ideological conflict which could influence the treating of this subject matter from a juridical point of view. The starting point, as indicated by the Author himself, is that of the Catechism of the Catholic Church.
