Abstract: This work tackles the issue of what forms of protection should be provided to victims of environment-induced forced displacement. An analysis of current and proposed laws is followed by a discussion on the most effective and practical path to be followed in order to provide a solid, legal basis for protection. Although Refugee Law has previously been considered as the main source of law to cater for the needs of these persons in need of protection, the reality is that wider International Human Rights Law principles as well as a variety of other sources of law may well have to be resorted to. This work is, in part, a reproduction of a dissertation, also exploring the institutional aspect of the issue, submitted by the author as part of an LLM at University College London in 2010.
