Abstract: The legal study considers the extent of protection from discrimination on the grounds of sexual orientation and gender identity in Maltese law. The legal analysis focuses on the areas of employment, freedom of movement, asylum and subsidiary protection, family reunification, freedom of assembly, protection from hate speech in criminal law, and particular issues related to transgender persons. The report considers the extent to which the available legal protection is effective in addressing homophobia, indicating areas that remain unaddressed and also highlights good practices.
