Abstract: In this article, Andrew Drago gives a thorough explanation of the main elements of military, martial, and public emergency law within Maltese law. A comparative legal exercise is conducted in referring to Indian, UK, and US jurisprudence, in light of the fact that Maltese public law is deeply rooted in the common law tradition. Moreover, it is submitted that military, martial, and public emergency law are three distinct bodies of law which respectfully regulate the Armed Forces of Malta. This article was submitted last year as part of PBL3002.
