A proposal for the introduction of a specialised domestic violence court in Malta

Abstract

This Research Project shall discuss and evaluate the possibility of introducing a specialised Domestic Violence Court to Malta. Domestic violence is a serious concern in Malta, as in all countries the world over, that has been addressed through the recent implementation of a quasi-comprehensive legislative framework which aims at regulating the crime of domestic violence itself, as well as protecting victims, sanctioning offenders and offering treatment and services to both parties. This legislative initiative represents a significant step forward from the social lethargy which surrounded the subject for centuries and has greatly improved the overall approach taken by the authorities towards domestic violence cases. It has also led to an increase in the amount of cases which are reported to the Police every year. Despite these advances, the adequacy and effectiveness of the judicial system which is currently empowered to handle these sensitive cases, hangs in the balance. Specialised Domestic Violence Courts, which have been established in a number of foreign democracies, tackle domestic violence cases head-on, taking a unique approach to give these cases the special attention they require. Establishing a judicial forum to focus on and deal specifically with domestic violence cases in Malta may arguably make the current system more effective and efficient. The recent surge in reported domestic violence cases therefore raises the question as to whether the introduction of a specialised court in Malta is now ripe for consideration. This will be the basic thread of discussion of this Research Project.
