Abstract: Counterfeiting and piracy have become an international occurrence and they both hold substantial economic and social repercussions. This also triggers malfunctions in the single market and strongly influences consumer protection, particularly in the public health and safety sectors. Such trends cause deflections of trade and falsification of competition resulting in loss of confidence in the single market operators, as well as a reduction in investment putting serious risks on national economies and governments. (EU, 21.01.2010) This report shall provide a more detailed description of the Customs Enforcement Unit role in the Intellectual Property rights. Joining the EU was a huge step for the Maltese Customs as it provided various opportunities. In addendum, we also conducted an interview with the Customs of Malta entities and a representative of the right holder. These interviews will help us highlight why there was a drastic change in the Statistics published by the EC Commission vis-a-vis the current situation in Malta. In the interview we will also depict opinions ranging from the customs officer to the right holder.
