Public trust in the Maltese administration : constitutional aspects and considerations

Abstract

This is a dissertation about ‘Public Trust in the Maltese Administration – Constitutional Aspects and Considerations’. This thesis examines the constitutional safeguards which limit the power of members of Parliament to ensure that the public trust shown during democratic elections is respected during the five years of tenure. This dissertation will analyse the fundamentals of Representative Democracy, the doctrine of Collective Ministerial Responsibility, the effects of a Member of Parliament voting against the party whip, votes of no confidence and resignations in Malta, constitutional conventions and positions of trust Questions asked during this dissertation Should the Constitution allow technocratic Ministers? Does a Member of Parliament’s right to vote against the Constitution derives from the Constitution? How are positions of trust regulated and can a motion against a person in a position of trust be presented?
