Abstract: Abortion is a contentious subject which has created much controversy along the years. The polar opposing statements ‘Pro-Life’ and ‘Pro-Choice’ feature mainly in the entire issue. To-date abortion in Malta has been banned and Maltese legislation makes no allowance for abortion to take place whatever the circumstances. The aim of this term paper is to research the topic in depth and explore arguments in favour or against abortion and more specifically abortion of a pregnancy resulting from rape. Analysing Maltese law and comparing abortion legislation in other European countries and the United States provides a general overview in this respect whilst concurrently granting an insight into the pros and cons of such legislation. Investigations were undertaken on whether abortion is morally right and what different views are presented to justify this argument. Furthermore it is imperative that the medical aspects of abortion be explored and comprehended so as to perceive the physical and psychological circumstances which are encountered by the pregnant woman who has been raped and is faced with such a trauma. Qualitative and quantitative research was conducted through interviews with professionals in the medical field and a questionnaire distributed via social media on the subject matter. Careful analysis of the results from such studies assisted in acquiring not only competent knowledge on the subject but it also revealed public perception on abortion and pregnancy resulting from rape. The rights of women over their body are measured against the rights of the foetus who is also a victim in the whole situation. Proving rape is never a simple issue and very trying on the pregnant woman who has just been through the traumatic experience of being sexually assaulted by her rapist. Abortion may or may not be a solution in the circumstances and this brings us back to the original argument of this term paper and the viability of introducing laws legalising abortion if a pregnancy has resulted from rape.
