dc.description.abstract | This thesis is concerned with legislation which governs the musician in various aspects during his professional career, specifically that regarding his live performance. The first chapter deals with the historical development of the music profession, with particular emphasis on certain progress in Malta. Next the theme of neighbouring rights is treated. Thirdly, the status of a performer is questioned and style protection is also taken into account. The fourth chapter goes over the salient practical features of the recording contract, highlighting the relationship of the musician with the record producer, whilst exposing the vulnerability of the performer. The relationship of the musician with the other players in the music industry such as the composer, the manager and agent as well as other band members is tackled in the last chapter. Finally, the conclusion pinpoints the weaknesses in this legislation and questions whether the law is protecting the dignity of the profession against the engulfing business moguls. | en_GB |
