Abstract: This dissertation analyses the state of democracy in Malta through a review of the salient provisions of the constitution concerning separation of powers and the rule of law. It is a corollary to constitutional law that it is practically impossible to investigate the entire constitutional order and therefore the author has decided to focus his research on three main topics, being unconstitutional laws; appointments, discipline and removals of members of the judiciary; and the office of the president.
