The use and abuse of rights in the right of ownership

Abstract

Being descriptive in nature the thesis provides a different analysis to the right of ownership as it tackles new ideas, which were not yet covered before. This will open a new debate on whether our articles in the Civil Code are sufficient to cover the new concept of ownership and whether new articles should be provided for, so to give a legal base to the new ideas the Court had to come up with to resolve the cases infront of it. The aim of this Thesis is not only to analyse what are the uses and what constitutes an abuse but tries also to put the right of ownership under a different perspective.
