dc.description.abstract | One might be tempted to commence this thesis by asking oneself what is law? Several theories on law has been propounded on a philosophical, economical, political and social ground. For the purpose of this thesis, we are only concerned with one definition of law which is a set of civil rules which must be observed by the community and in respect of the non-observance of which a sanction is imposed by law which is capable of being enforced. This is how justice is administered effectively. Otherwise, justice and law would be nothing else and nothing more than a farce, a system of law which would be a mere formality and justice carried out only as a top-service before the Courts. Hence, law has not only to be enacted by the legislator and interpreted by the Courts but the command of the law must also be capable of execution through the channels of the law itself which channels are regulated and controlled by the Court in order to see that justice is both effectively and honestly administered without any fear or abuse in its execution. | en_GB |
