Abstract: The main objective of this dissertation is to quantify the magnitude of cybercrime enforcement. Substantive Maltese Criminal Law will be examined in detail to analysis whether current Maltese Law can protect cybercrime victims and punish perpetrators. This study will thoroughly define the term cybercrime and examine the necessary elements which can indict a person of cybercrime. Legislation such as that of the United States of America, a pioneer in cybercrime communication will also be taken into consideration as a means of benchmark and analysis. This exercise will enable the study to compare and contrast various legislative enforcement mechanisms to derive the strengths and weaknesses, in an attempt to identify subject areas in need of development. Since cybercrime can easily cross borders and continents, a deep understanding of the Convention on Cybercrime will highlight the importance of co-operation between Countries and States for the enforcement of cybercrime legislation.
