Abstract: The objective of this thesis is to identify and analyse this notion of professional secrecy prior and subsequent, to the enactment of the Act. This thesis deals with the meaning and rationale of this duty, with the persons bound by it and the type of secrets protected. A comparative study, of the main elements of professional secrecy, is undertaken with a view to achieve a better understanding of the situation obtaining in Malta. The concept of professional secrecy is not new to the Maltese legal system. It is therefore inaccurate to state, that Act XXIV of September 13, 1994 has introduced professional secrecy into Malta. Obligations of secrecy and confidentiality exist throughout Maltese legislation.
