Abstract: | From quite early times, Roman Law distinguished between two types of heirs: obligatory heirs and outside heirs. Obligatory heirs were so called because the inheritance devolved on them automatically without any choice on their part. Outside heirs, on the other hand, were those who, not being under the 'potestas' of the testator, were free to renounce or accept the inheritance. |
