Abstract: The Maltese Law on possession has been influenced by various sources, i.e. by Roman Law, French custom, Canon Law and the German theories. There seems on the other hand little doubt that Roman Law is the fons et origo of the modern system of possession. Perhaps one can object that the various norms of diverse origins are not sufficiently co-ordinated; therefore to trace the notion of' possession to the 'spirit of Roman Law' becomes all the more important, not merely for historical purposes only.
