Abstract: The principle that marriage law is the law governing marriages in Malta has always been upheld. Sir John Lintorn Arabin Simmons in a declaration made to Cardinal Rampolla in 1889, stated “The law in Malta in regard to the form necessary to the validity of a marriage, oven as a contract, is the Canon law and in that respect the Canon law is also the civil law of Malta (Dobono, p.388). Simmons confirmed this view in letters written to the Marquis of Salisbury in 1890.
