Abstract: It proposed to discuss in this thesis the status and responsibilities of the Auditor in Company law. We shall examine the historical development of the Auditor, his juridical character, appointment, qualifications, disqualifications, remuneration, removal, as well as his rights and corresponding duties and liabilities both towards the company as well as towards third parties. As the qualifications required of an auditor vary according to the nature of the company, reference will be made to the distinction between various types of companies. All these aspects will be examined in the light of the Commercial Partnerships Ordinance, Act No. X of 1962, which is the prevailing law regulating companies in Malta, as well as foreign Acts, particularly the English 1948 Companies Act and the 1967 Companies Act.
