Abstract: The debate over criminal laws forbidding certain varieties of sexual conduct has become the ‘locus classicus’ of modern interest in the limits of criminal law. The recommendations both of the American Law Institute in the U.S.A. and the Wolfenden Report in England as well as legislative revisions in the past few years in most European countries have all contributed to the impression that somehow this is the question in the criminal law.
