dc.description.abstractThe origins of the actiones de novi operis and damni infecti can only be traced as far back as Roman Law and are both of praetorial origin. Their preventive character is of practical importance and this is sustained by the fact that they have been retained throughout history in the major civil codes. Even though they might have simply given rise to a temporary remedy, they have reappeared in modern legislation with the same structure and with no less use.en_GB
