Abstract: | Marriage, being the union of two persons for life, necessarily gives rise to questions relating to the patrimonial interests of both parties. Consequently, systems regulating those patrimonial interests have been created in all countries and in all ages in order to avoid conflicts which would unavoidably result between the interests of the rife and of the husband, such an intimate common life. Developments and evolutions have naturally taken place throughout the ages, bringing about different view a and progressive concepts on marriage and the respective rights of husband and wife. The present systems and tendencies throughout the civilized world, divergent as they might be, ere the result of these developments and new concepts, and a brief survey of present matrimonial regimes in different countries will clearly show the principal modern trends of thought on this important social institute. Baudry Lacantinerie, in a comparative study between the various systems adopted by the different codes, divides matrimonial regimes into three principal groups. |
