Abstract: This dissertation is a study with a particular focus on the death penalty within the local scenario. It probes into the historical context, illustrating factors leading to various changes and developments and final abolition. This study delves into the socio-political factors which gave rise to the need and eventual formal promulgation of the Penal Code. The introduction of the mechanism of trial by jury and the means through which it was applied in Malta is looked into. Factors affecting the development of the humanisation process such as the gradual change in mentality and the contribution of the newspapers are also presented. The absent role of the Catholic Church within this process is also mentioned. Developments taking place within the Criminal Code of 1854 affecting the death penalty are reviewed through an examination of articles. This study finally focuses on the lengthy process leading to the abolition of the death penalty from the Criminal Code, and its total removal from Maltese legislation.
