The rights of any suspect during the initial and subsequent interrogation by the police : a comparative analysis between eu and non-eu countries based on the Miranda rights

Abstract

This dissertation is titled 'The rights of any suspect during the initial and subsequent interrogation by the police: A comparative analysis between EU and Non-EU countries based on the Miranda rights. ' The main notion of this dissertation is the exploration through a number of published and unpublished documents to verify whether the rights of any suspect during an interrogation by the police after an arrest are being observed in Malta. Thus, this dissertation is a comparative analysis based primarily on the Miranda rights in America as well as in other Non-EU countries in a comparison with other European Countries such as Italy and France where the former already provides the suspect with the right of presence of legal aid during an interrogation. To complete this study a qualitative approach was used and so interviews with police officers, lawyers and Members of Parliament were conducted to gather firsthand knowledge from people working in this particular field. The general public were also interviewed to obtain gauge awareness on the topic.
