Abstract: This paper focuses on the position of the promise of sale agreement in Malta with particular attention to the rights and obligations that arise from entering into such an agreement. While detailing the various features of the notion of the promise of sale as well as the various amendments effecting the promise of sale in recent years, the primary focus of this paper is a juridical analysis of the areas of contention and extracting the features of the promise of sale which to date are still riddled with misconception.
