Leading cases in Maltese administrative law

Abstract

The collection of these judgments on Maltese administrative law makes interesting reading. Most of them relate to judicial review. The subject of judicial review has always fascinated me, mostly because of the wide range of circumstances, events, incidents and situations the subject covers. An entire gamut of actions relating to the most extraordinary cases have enriched our jurisprudence on the subject. A renewed consciousness of one's rights, and a gradual increased audacity by the court in reviewing administrative actions, have contributed to the establishment of administrative law in Malta as a subject in its own right. This is not to say that the courts have not foundered, erred, failed or contradicted themselves in several judgments, as one can see in this work. For instance, I am highly critical of the strict interpretation of certain procedural issues which have hampered citizens' rights to challenge actions by public authorities.
