Abstract

Judgment of the Judicial Committee of the Privy Council on the Appeal of Antonio Dimech v. Thomas Corlett, from the Royal Court of Appeal at Malta; delivered on the 14th day a{ July, 1858.

Present: Judge Of The Admiralty Court. Chancellor of the Duchy of Cornwall. Judge Of The Court Of Probate. Sir J.T. Coleridge.

This was an appeal from a judgment of the Royal Court of Appeal at Malta, reversing a judgment in favour of the appellant, the plaintiff below, given by the Royal Commerciai Court there. Two questions substantially were raised in the argument before us : the first, whether., under the circumstances, the plaintiff could maintain any action against thè defendant; and the second, supposing the first to be answered in the affirmative, on what principle the damages recoverable should be assessed.

Quest’era un appello da una sentenza della Regia Corte di Appello di Malta, che revocava un'altra della Regia Corte di Commercio, favorevole all'attore appellante. Due punti di questione furono sostanzialmente mossi inannzi di noi nella trattazione: uno cioè, se sotto le circostanze del caso, l'Attore poteva sostenere alcun'azione contro il reo-convenuto; e I'altro, supponendosi risoluto affermativamente il primo, sopra qual base dovessero essere liquidati i danni dovuti.
